Press Statement: Celebrating the 14th Anniversary of Kenya’s New Constitution

As Kenya marks the 14th anniversary of the adoption of its new constitution, the Social Justice Movement reaffirms its steadfast commitment to defending the vital gains enshrined in this foundational document. Since its enactment, the constitution has served as a cornerstone for democratic governance, guiding the nation’s development and safeguarding the rights of its citizens.

Yet recent events signal a troubling trend: the very principles of the constitution are increasingly under threat. The protests led by Gen Z activists highlight the urgent need to defend these hard-won gains. The state’s response has been deeply concerning.

There is a disturbing escalation in the suppression of dissent. Civic space is shrinking as activists face threats, arrests, and, in some instances, physical harm. Enforced disappearances and police brutality targeting youth leaders are becoming more frequent, reflecting a growing intolerance for democratic engagement.

Equally alarming is the pattern of the government circumventing constitutional mandates, acting in ways that contravene its principles. We categorically condemn such actions.

Parliament, whose role is to provide oversight and safeguard the public interest, has in some cases aligned with executive priorities, enabling exploitation rather than enforcing accountability. The recent introduction of a bill seeking to restrict the right to protest, under the guise of protecting the executive, undermines the core of Kenya’s democratic framework.

A constitution is only effective when its institutions remain independent. We call for the protection of these constitutional bodies from capture or undue influence, ensuring they can uphold the rule of law and democratic principles.

We urge all Kenyans to remain vigilant and proactive in defending the constitution. It is our collective duty to preserve our democratic rights and freedoms. Together, we must act to safeguard the integrity of the constitution and protect democracy for generations to come.
