Press Statement: Celebrating the 14th Anniversary of Kenya’s New Constitution

As we mark the 14th anniversary of the adoption of Kenya’s new constitution, the Social Justice Movement reaffirms its unwavering commitment to safeguarding the significant gains embedded within this foundational document. Since its inception, the constitution has been a genuine guide in shaping our nation’s direction, promoting democratic principles, and protecting our rights.

However, recent events have highlighted a troubling trend: the very principles enshrined in the constitution are increasingly under threat. The recent protests led by Gen Z activists underscore a critical need to defend these constitutional gains. Unfortunately, the response from the state has been alarming.

We are witnessing a disturbing escalation in the suppression of dissent. The state has resorted to shrinking the civic space by threatening, arresting, and, in some cases, maiming voices that challenge the status quo. Cases of enforced disappearances and police brutality targeting youth leaders are on the rise, reflecting a growing intolerance for democratic engagement.

Moreover, there has been a concerning pattern of the government bypassing the constitution, acting in ways that contravene its principles. We unequivocally condemn these actions.

Parliament, which is supposed to act as a check on government power, has instead aligned itself with the government’s agenda, enabling exploitation rather than holding power accountable. Recently, Parliament has introduced a bill designed to severely restrict the right to protest, ostensibly to protect the executive branch but effectively undermining the very essence of our democratic framework.

A functional constitution requires independent institutions to uphold its principles. We call for the protection of these constitutional institutions from state capture and undue influence.

Going forward, we urge all Kenyans to remain vigilant and proactive in defending our constitution. It is our collective responsibility to ensure that our democratic rights and freedoms are not compromised. Let us rise up together to protect our constitution from being mutilated and to safeguard our democracy for future generations.
